📑 Terms and Conditions of GC Buildtruction LLC

Purpose and Scope

These Terms and Conditions govern the relationship between GC Buildtruction LLC (hereinafter, “the Company”) and the Client (hereinafter, “the Client”) regarding the contracted remodeling, construction, and maintenance services, including but not limited to:

  • Interior remodeling (Basements, bathrooms, flooring, painting, finishes).

  • Construction of additions and new structures.

  • General maintenance and repairs.


Estimates and Quotations

  • All estimates provided by the Company shall be valid for 30 days from the date of issue.

  • Prices may vary in case of:

    • Increases in material costs.

    • Modifications requested by the Client.

    • Unforeseen conditions at the project site (structural, weather-related, or safety issues).

  • Any changes must be documented through a Change Order signed by both parties, which will adjust the price and/or project timeline accordingly.


Prices and Payments

  • The payment schedule will be as follows:

    • 30% deposit upon signing the contract (non-refundable).

    • 40% upon reaching 50% project completion.

    • 30% upon final delivery and Client acceptance.

  • All payments must be made by the agreed due dates. Late payments will be subject to 8% annual interest or the maximum allowed by local law.

  • The Company may suspend work in the event of non-payment.


Permits and Client Responsibilities

  • The Client is responsible for:

    • Obtaining and covering the cost of permits, licenses, and authorizations required for the project, unless otherwise agreed in writing for the Company to handle them.

    • Ensuring access to the property and safe working conditions.

    • Providing accurate information regarding existing installations (electrical, plumbing, structural).

  • The Company will not be held liable for delays caused by permits, legal restrictions, or lack of property access.


Project Timeline

  • Delivery dates are estimates only.

  • Timelines may be extended due to:

    • Adverse weather conditions.

    • Delays in material deliveries by suppliers.

    • Modifications requested by the Client.

    • Unforeseen circumstances beyond the Company’s control.


Materials and Warranty

  • The Company agrees to use quality materials as specified in the contract.

  • Workmanship warranty: 12 months from the date of project delivery.

  • Material warranties will be subject to manufacturer coverage.

  • The warranty does not cover:

    • Damages caused by misuse, lack of maintenance, accidents, natural disasters, or third-party interventions.

    • Minor variations in finishes, colors, or textures inherent to the materials used.


Photographs and Promotional Material

The Company may document the project with photographs or videos before, during, and after completion for portfolio, marketing, and promotional purposes, unless the Client provides written objection prior to the start of the project.


Cancellations

  • Before project start: the Client may cancel, but the 30% deposit will be non-refundable.

  • After project start: the Client shall cover:

    • Costs of work performed up to the cancellation date.

    • Costs of materials purchased (especially custom orders).

    • A 20% penalty on the remaining contract balance.


Limitation of Liability

  • The Company shall not be liable for indirect damages, economic losses, loss of profits, or inconveniences resulting from project execution.

  • The Company’s maximum liability shall be limited to the total contract value.


Confidentiality

Both parties agree to keep confidential any technical, financial, or personal information exchanged during the contractual relationship.


Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Kansas City, KS and Kansas City, MO. Any disputes shall be submitted to the competent courts of Kansas City, KS and Kansas City, MO


Modifications

The Company reserves the right to update or amend these Terms and Conditions at any time. Changes will be communicated to the Client and shall take effect on the date indicated in the notification.
